What is a counterfeit mark?

A counterfeit mark is a mark which is substantially indistinguishable from another protected trademark. For example, if someone flat-out copied Nike’s “swoosh” trademark and placed it on their own sneakers, they would be using a counterfeit mark. Use of a counterfeit mark is obviously one form of trademark infringement.
