My procedure wasn’t successful. Can I sue for malpractice?

Not necessarily. Again, surgeries will not all be successful; the question is, did you doctor deviate from the standard of care. Doctors must only practice with the necessary knowledge and experience required in the area; they are not, however, guarantors of success. Treatments and procedures come with certain risks involved, and so long as you are informed of those risks and the doctor’s negligence or incompetence is not responsible for the unsuccessful procedure, a medical malpractice claim will not succeed.
