
When is unequal pay not a violation of the Equal Pay Act?
There are some situations in which people of different genders are being paid different wages for similar work; in the following situations, this is not a violation of the Equal Pay Act: 1) if a valid seniority system exists; 2) for some types of piecework; 3) for merit-based pay systems; and 4) when entry level salaries are based on the employee’s experience and not upon gender.
