Do I have to take compensatory time in lieu of overtime pay?

To avoid paying overtime pay, some employers try to provide compensatory (comp) time, instead. However, in most state, it is illegal to substitute comp time for overtime pay. It is legal, however, to plan an employee’s schedule around time worked, i.e. provide time off to an employee within the same time period at a rate of at least one and a half times the hours worked overtime.
