When is divorce mediation a bad idea?
Divorce mediation is not right for every couple. In many instances, mediation won’t work at all, especially when one spouse doesn’t want the divorce, where the couples have difficulty communicating, where one spouse is hiding financial information from the other spouse, or where the spouses refuse to be flexible. If there is a lot of bitterness and anger, mediation won’t work either, especially if one spouse doesn’t want the divorce. Furthermore, if you have a bad mediator (especially one who takes sides), mediation is not the right answer. Also, keep in mind that the attorney-client privilege (in most states) does not extend to divorce mediators.
